Plan Your Fence

It’s not a matter of which side of the road your yard ends up on, it’s about understanding how far into your neighbor’s yard you can legally go without their. In this agreement, your neighbor acknowledges that their building was not properly constructed, and you agree to allow the structure to remain standing. If you destroy your neighbor’s structure, you are responsible for rebuilding it on your neighbor’s property. If you don’t want to go through the trouble of filing a boundary line adjustment, you could just sign an agreement with your neighbor. You should always do something if you are selling or transferring the property, regardless of your decision. Fence Post Spacing Guide

The structural integrity of your fence depends largely on the materials you choose and how far apart you space the posts.  Too far apart and the strength of your fence is compromised.  Too close and your fence may look strange. For most privacy and general purpose fences, 6 to 8 feet between posts is standard. It’s always good to double-check the manufacturer’s recommendations for proper spacing.

Wooden Fences

If you are using pre-made fence panels, the post spacing is already determined. If you’re building your own fence, choose a distance of between 5 and 8 feet. We recommend that you have 6 or 8 feet intervals.

Wire and Other Fences

There are many types of wire fences, and each type can be stretched out at 15 foot intervals, depending on the purpose. When it comes to other fence materials, spacing should be anywhere between 6 and 20 feet.

 

How Deep Should a Fence Post Be?

Prepare a post hole that’s about 6 to 8 feet tall, and dig it 2 feet deep. To install a fence post, you’ll need a shovel or post digger, a 6 foot level, soil and gravel or crushed. If you want your garden gate posts to last, you’ll need concrete too.

 

Should Fence Posts Be Set in Concrete?

If the fence is long, the next best thing to digging a lot of holes is to hire a landscape contractor who has a power auger. You’ll only have to pour a concrete footing for posts that support a gate, are freestanding at the end of the fence, or when rock stops you from digging deep enough, a third of the post’s length. Concrete is an expensive and slow process, but post brace construction is necessary to ensure the posts stand up straight.

Building a Fence? Do These 5 Things First

Whether your dog is a high jumper or not, it is good to establish some limits for your pet. Your house might actually look better if you added a picket fence in front. Whatever the reason, you want to build a fence around your yard. Before you start bribing your friends to help, stop and do your fence homework. A new fence adds value to your home (learn how), not causing disputes with neighbors and city code inspectors. Don’t worry. We’ve got your back. Before you dig that first post hole, follow these steps to prevent fence feuds.

 

5 steps to take before you install a fence

1. Have your property surveyed.

Your neighbors will not like it if you build a fence on their lawn that could create legal trouble for you. If you’re building a fence, you’ll first need to have a land survey to make sure that you’re building it on your own property. Housebound surveys are done each time a house is sold. According to an article in the San Francisco Chronicle, an old survey won’t reflect changes that could have happened to and around the property over time. A property survey is usually performed once every 5 years. If your survey is more than 5 years old, or if you haven’t gotten one recently, it’s time for a new one. You can never rely on what the next person says or what they remember. You should always get a survey done before anything is moved. A survey will tell you whether your fence is encroaching into your neighbors’ yard and, if so, by how much.

2. Learn your local fence rules.

This country has ordinances and laws regarding the construction of fences. If you live in a historic area or in a neighborhood governed by a homeowners association, you may need to follow additional rules. Your fence design might require committee approval. Find the right materials and design your own fence. Get started by reading this article and learn the basics.  Grand Rapids, Michigan, does not allow chain link fencing in front yards. The front yard must be at least 30 inches tall. No taller than six feet. In the historic district, the front yard fences have to be similar to historic fencing styles.

3. Give the neighbors a heads up

After you’ve had your land surveyed, talk to your neighbors about your fence plans, because it’s important to make sure you’re not getting into any legal trouble when you build your fence. Make sure that the neighbors know you plan to build a fence before you actually do, otherwise they might not let you build it. If they’re willing to sign an easement or boundary agreement, they’re probably cool with it. Maybe they’ll love the idea and offer to help pay for it. But please don’t expect them to. If they don’t love it, there are always options for working things out or just proceeding with your plans. It’s your land, and you aren’t breaking any laws.

4. Give your neighbors the good side

Yep. Sometimes cities do require it, even if they don’t, it’s the way to go. Your fence will look better from the street. It’ll give your house a neighborhood presence, and your neighbors might even invite you over for a glass of wine. 5. Plan to maintain

To properly care for your fence, you’ll need to take proper care of both sides. If you want a strong, durable fencing that will last for years to come, choose vinyl or vinyl composite. If your kids play soccer every weekend, then you probably don’t want a wooden fence that needs repainting or staining. Vinyl siding is probably a better choice than wood. Prescriptive Easement

If you have property outside your property line, and your neighbor is allowed to use it outside the boundary of the property line, you may have an easement over that portion of your property. A legal type of property easement, a recreational easement, is earned by the regular use of a piece of property. While your neighbor might not be able to get a legal title to the land or be able to sell it, they may still be able to claim a legal right to use the land. Clearly, if you’re not using the property, and the landowner is using the land for a purpose that is consistent with their deed, the landowner may be able to claim an easement by prescription. This can make it difficult if you ever want to move the fence outward. There are potential problems with selling your home, which means that it may not be the best decision for you. First of all, you have to make sure you can sell your home.

Adverse Possession

An adverse possession claim can be a very effective way to block a neighbor’s property from being used in a way you don’t like. If a property trespasser (such as your neighbor who uses the small strip of land outside the fence) has exclusive and continuous use of the property for a number of years, he or she may legally claim ownership of the property. When you have a fence installed inside your property line, be sure to use your property tax statements and notice anything that changes on your tax bill. If the land suddenly goes up in value, the adverse possession can be claimed in as little as 5 years. What is a Good Neighbor Fence?

A good neighbor fence is a fence that is shared between two homes. You don’t have to have an ugly fence to your home. Instead, this type of fence has the benefit of creating a place where both your neighbors have the pretty side of the fence. What is the height limit for a fence?

Residential fencing laws limit the height of artificial fences in residential areas to four feet in front yards and six feet in backyards. Most cities, counties and subdivisions have restrictions on fence height and materials, so check before you build. Many local fencing laws contain restrictions on natural fences made of bushes or trees. Fences are commonly used to designate property boundaries. The neighbor may sue under these statutes for its removal.

 

My neighbor’s fence violates a local ordinance. How can I have the ordinance enforced?

The neighbor may not be aware of the law, so it is important to inform the neighbor of the violation. If the neighbor refuses to make changes, tell the city. The city will send a letter to the neighbor requesting conformance. If the neighbor refuses to conform, the city can fine the neighbor and sue the neighbor for non-compliance. You may have to take legal action against your neighbor if he or she does not remove the fence, but this will not result in the removal of the fence. If you would like the fence removed, a trial judge can issue an injunction against the neighbor.

 

Are Neighbors Allowed To Attach Things To My Fence?

This all depends on whether it’s your fence or not. If it’s yours, and not your neighbor’s, then the answer is no. You own it, and only you have the right to decide what happens to it. Include any other modifications you want to make to your tent, such as adding shelves, a hammock or other accessories. If the fence is owned by you and your neighbor, the situation gets a bit more complicated. Generally speaking, you can let anyone put things on their side of the fence as long as they are not putting anything up on yours.

 

What Should I Do If My Neighbor Attached Something To My Fence?

If someone broke into your yard, stole your bicycle, or attached something to your fence, it would be normal to feel a little concerned. It can be difficult to figure out what to do. The truth is that you can solve this issue in the same ways you can solve most other fence related problems, including unwanted modifications to your fence. Figure Out If It’s Really An Issue
